Idaho Bans Gender-Affirming Care For Children
The Supreme Court has allowed Idaho to enforce its ban on gender-affirming care for transgender youth — reversing earlier lower-court decisions as legal challenges proceed. Despite the ban, the two transgender teens challenging the law can still access care, according to the court's order.

What is the left saying?Many on the left are outraged by this Supreme Court ruling: Justice Ketanji Brown Jackson criticized the Supreme Court's intervention in Idaho's transgender care ban. "In my view, we should resist being conscripted into service… in the midst of active litigation” Justice Jackson believed that in this case “micromanaging” lower courts shouldn’t have occurred — especially as legal proceedings continue. The American Civil Liberties Union, representing the teens and their families challenging the law, described the ruling as a severe setback for transgender youth in Idaho. "Today's ruling allows the state to shut down the care that thousands of families rely on while sowing further confusion and disruption.” The law has triggered protests and many on the left are worried that it might raise suicide rates among transgender teens. | What is the right saying?However, the right were much more welcoming of this decision: Justice Neil Gorsuch of the conservative majority wrote that it is “a welcome development” that the court is reining in an overly broad lower court order. Idaho Attorney General Raúl Labrador stated that the law protects children from life-altering treatments — asserting that medical care should acknowledge biological differences and that denying these truths harms children. “[The law] ensures children are not subjected to these life-altering drugs and procedures.” Many other states have enacted laws restricting or banning gender-affirming medical care for transgender minors.
